2. Order and Payment Terms

• Product Information: All products are described as accurately as possible. However, we cannot guarantee that the display of colors or other details on your device will be completely accurate due to differences in screen resolution and lighting differences.

• Pricing: Prices are listed in USD. Prices may change without notice, but you will be charged the price listed at the time of checkout.

• Order Acceptance: All orders are subject to acceptance. Once we process your order and confirm it, we will send you an order confirmation email.

• Payment: We are currently only accepting payments through PayPal as a third-party provider. Payment must be received before your order is processed. We hope to accept major credit cards (Visa, MasterCard, American Express) and Buy Now Pay Later options (Affirm, Afterpay, Shop, Klarna, etc.) in the future.

• Processing Time: Orders are processed within 3–5 business days after payment is confirmed. Custom orders may take longer.

• Shipping Methods: We offer standard and expedited shipping options within the United States. Shipping costs are calculated at checkout.

• Shipping Time: Estimated delivery time will vary based on your location. Typically, delivery takes between 3–7 business days for standard shipping.

• Shipping Fees: Shipping costs will be added at checkout. The final cost depends on your order size and shipping method selected.

• Domestic Only: We currently only ship within the United States. We do not offer international shipping.

• Shipping Delays: We are not responsible for any delays caused by shipping carriers or weather conditions.

4. Returns, Refunds and Exchanges

• Return Policy: We accept returns for non-customized products within 14 days of receiving the item. To be eligible for a return, the product must be unused, in its original condition, and in its original packaging.

• Non-Refundable Items: Customized or personalized items (such as custom car decals, dog tags, or bookmarks with personalized text) are non-refundable unless they arrive damaged or defective.

• Defective Products: If you receive a defective or damaged product, please contact us within 7 days of receiving the item. We will either send you a replacement or issue a refund, depending on the issue.

• Refund Instructions: To initiate a return or refund request, please visit our Refund Policy page. Once we approve your return, we will provide instructions for returning the item. Please note that the cost of return shipping is the customer's responsibility unless the return is due to a defect or our error.

5. Custom Products & Third-Party Designs

• Custom Orders: We offer personalized products, including custom car decals, bookmarks, dog tags, and other items. Customization options, such as text, images, and colors, are available on the product pages.

• Approval Process: For custom products, you may receive a proof or mock-up via email within 2 days before we begin production. Please review and approve the design. Once approved, no changes can be made.

• No Refund on Custom Orders: Due to the nature of custom products, we cannot accept returns or offer refunds on personalized items unless the item is defective. Please ensure that all customization details (e.g., spelling, design) are correct before approving the proof.

• Cricut Generated Designs: Some of the designs featured in our products, including but not limited to car decals, bookmarks, and dog tags, may incorporate images, fonts, or other elements from Cricut. These designs are used under the appropriate commercial use licenses granted by Cricut, in compliance with their Terms of Service ("Angel Policy"). We ensure that all Cricut designs used in our products are licensed for commercial use and are legally compliant with Cricut’s guidelines.

• Cricut License Limitations: Customers are prohibited from using, reproducing, or reselling any Cricut images or designs used in our products unless they have obtained their own commercial license from Cricut. The purchase of a product featuring a Cricut design does not grant the customer any rights to the design itself. You are purchasing the physical product, not the intellectual property rights to the design. 

• Personal Use vs. Commercial Use: By purchasing a custom product that incorporates Cricut designs, you acknowledge that these designs are licensed for commercial use in our products only. Customers may not recreate, redistribute, or use these designs for resale or other commercial purposes unless they have a separate license from Cricut.

• Cricut Ownership and Use of Custom Designs: By purchasing a custom product that incorporates third-party designs (e.g., Cricut images), you are purchasing a physical product with that design, and you do not own the rights to the design. Any designs provided for custom orders are for personal use only unless explicitly stated otherwise. If you provide a custom design to be used in our products, you grant Kreative Koukla the right to use, modify, and produce the design for the purposes of fulfilling your order. However, you retain ownership of the submitted design, subject to the rights of Cricut or other third-party content providers (e.g., fonts, images). Upon purchase of the custom product, the customer does not acquire ownership of the design, but only the physical product itself.

6. Disclaimers

• Color Accuracy: While we strive to provide accurate images of our products, please note that colors may vary slightly due to differences in monitor settings and lighting. The product you receive may not look exactly as it does on your screen.

• Material Availability: Due to material availability, certain products may be made with different materials or finishes than what is shown in product images. In the event that a specific material is unavailable, we will substitute it with a similar material of equal quality. If an item arrives that does not look like pictured item and you are unsatisfied - you may initiate a return, refund or exchange.

• Product Variations: Many of our items, especially those made with natural or custom materials, may not be exactly the same. Variations such as slight differences in size, color, pattern, and texture may occur due to the handmade or personalized nature of our products.

• Copyrighted Material: Some of the products we offer, particularly custom designs, may incorporate copyrighted images, fonts, or other content from third-party providers, including Cricut. We comply with all licensing terms set forth by these third parties, including the appropriate use of licensed images and designs.

• Restrictions on Usage: The images or content from Cricut and other sources are used in compliance with their commercial licensing agreements. Any unauthorized reproduction, distribution, or sale of these images by customers is prohibited.

• No Transfer of Rights: The purchase of any product containing third-party designs, including those from Cricut, does not transfer any intellectual property rights to the customer. By purchasing, you are purchasing only the physical product, not the rights to reproduce, resell, or distribute the designs used in that product.

• Customer Responsibility: By purchasing our products, you agree not to reproduce or sell any Cricut design or other third-party design used in our products unless you have obtained the necessary commercial rights or licenses from the respective content owners.
